Some countries require corporate buyers to withhold a percentage (5-15%) of software subscription payments before remitting. The withheld amount is either recoverable under a tax treaty or expensed as a cost of doing business.

Collect withholding tax certificates from customers as evidence for treaty credit claims in the SaaS company's home jurisdiction.

⚠️ Audit Flags

Auditors verify that withholding tax receivables are recoverable — if a treaty credit claim has been pending for more than 12 months without resolution, the receivable may need to be impaired. They also check that revenue is recorded gross (before WHT) with the WHT as a separate asset or expense line.
