How to Record Contingency Fee Revenue (Litigation Win)
Recognizing revenue from a successful court judgment or settlement where the firm earns a percentage of the total award.
| Account Name | Type | Debit ($) | Credit ($) |
|---|---|---|---|
| Cash - Operating Account | Asset (+) | 33,333.33 | - |
| Legal Service Revenue - Contingency Fees | Revenue (+) | - | 33,333.33 |
💡 Accountant's Note
Under ASC 606, contingency fees are considered 'Variable Consideration.' Because the fee is contingent on a future event (winning the case), revenue is generally recognized only when the uncertainty is resolved—i.e., when the settlement is finalized or the judgment is rendered. The firm records its portion (usually 33% or 40%) as revenue upon receipt of the settlement funds.
Practitioner & Systems Framework
💻 ERP Architecture
Contingency matters should be tracked with a '$0' billable rate in the system to prevent phantom WIP, with the final fee manually entered upon the case closing.
⚠️ Audit Flags
Premature recognition. Recognizing revenue before the 'Right to Payment' is unconditional (e.g., while a judgment is still under appeal) is a common audit finding.
📄 Required Documentation
Signed Settlement Agreement, Court Order, and the Closing Statement (HUD-1 equivalent for legal cases) showing the distribution of funds.
