Subrogation rights are tracked in the claims management system as a component of the claim file, separate from the original paid claim amount. The subrogation receivable is only raised when recovery is virtually certain — typically when the at-fault party has admitted liability or a judgment has been obtained. Some insurers use a specialist subrogation unit or outsource to a recovery agent. The recovery reduces claims expense in the period it is received or becomes virtually certain.

⚠️ Audit Flags

Auditors test that the 'virtually certain' threshold is met before recognising a subrogation receivable — premature recognition inflates investment returns and understates claims expense. Review the aging of subrogation receivables for amounts that have been outstanding for more than 12 months without progress. Confirm that where a reinsurer has also recovered a portion of the claim, the subrogation recovery is appropriately split between the cedant and reinsurer according to the treaty.
