💡 Accountant's Note

When a claim is disputed and goes to court, a litigation reserve is set based on legal opinion. Legal costs (LAE) are reserved separately. The provision follows IAS 37 criteria — probable and estimable.

Disputed claims that proceed to litigation are flagged in the claims system under a 'litigation' status and assigned to the legal department or external legal counsel. The litigation reserve is set based on legal counsel's opinion on quantum and probability of an adverse judgment. Legal costs (LAE) are tracked separately as a sub-component of the claim. The legal team provides quarterly updates on litigation progress, and the reserve is revised accordingly. Significant litigation must be disclosed in the financial statement notes under IAS 37.

⚠️ Audit Flags

Auditors obtain confirmations from external legal counsel for all significant litigation matters — legal confirmations are a standard audit procedure confirming the counsel's assessment of the likelihood and quantum of the claim. Reserves that differ materially from legal counsel's assessment require explanation. Assess whether any litigation involves coverage disputes that may affect the validity of the insurer's reserve — if the insurer's coverage is found to be broader than expected, the reserve may be understated.
