💡 Accountant's Note

When fraud is proven, the reserve is fully released as no payment will be made. The release is a credit to claims expense. Fraud investigation costs (legal, SIU) are expensed separately.

Fraud-identified claims are processed in the claims management system under a 'repudiation on grounds of fraud' status. The full reserve is released only after a formal fraud determination — supported by the Special Investigation Unit (SIU) report and legal counsel's advice. The claim file documents the fraud evidence, the repudiation letter sent to the claimant, and the legal risk of the repudiation being challenged in court. Fraud statistics (number and value of fraud repudiations) are reported to management and the Board.

⚠️ Audit Flags

Auditors confirm that fraud repudiations are supported by sufficient evidence — releasing a reserve on suspected fraud without sufficient evidence is inappropriate. Confirm that the repudiation letter was properly issued to the claimant, as failure to formally repudiate may create an implied acceptance. Review any claims where fraud was suspected but not pursued — the reserve should reflect the risk of having to pay even a fraudulent claim if the evidence is insufficient. Track SIU investigation costs separately and confirm they are expensed to LAE, not netted against the fraud reserve release.
